Eric Carlson, George Peek and Laura Schuett have received a favorable decision in the Wisconsin Supreme Court in an asbestos matter pending since 2010 where the Court agreed that our client was not a successor to a business whose assets, but not liabilities, that it purchased. This precedential decision found that the Wisconsin Uniform Fraudulent Transfer Act does not govern the “fraudulent transaction” exception to the rule of successor non-liability.
