Supreme Court Summary Judgment Ruling
01/29/2010 - Don Carlson with Tim Maciolek obtained a summary judgment in the Supreme Court of the State of New York, Bronx County, dismissing a product liability claim against the manufacturer of a snow blower. Plaintiff lost a finger of his left hand and sustained other injuries when he attempted to unclog the discharge chute while the engine was running. It was alleged the snow blower chute was not properly guarded, the snow blower should have been sold with a clean out tool as now is the practice, and that insufficient warnings and instructions were provided. In dismissing the case, the Court rejected plaintiff's arguments finding no evidence that the snow blower was defective or negligently designed or manufactured.
